The flaws and inadequacies in our judicial system are often discussed meaning that it requires complete overhaul. Some issues like corruption in judicial system, misuse of judicial system by mighty to delay justice, out of the way intervention by the judiciary in political issues also needs to be importantly addressed for the robust growth of the country’s economy by improving the efficacy of the system. It is true that the impact of cancellation of licences and deals by the court in coal scam case has affected the corporate sector but this cannot be taken as a case of conflict between executive and judiciary.
I myself have been a recipient of fighting a PIL which delayed a Project of national importance for over 6 years. It was frivolous and a chance to blackmail by all the elements concerned. Fortunately despite this arduous wait Justice was delivered by delay of 6 years it nearly killed the Project.
I todays Industrial environment of Make In India etc etc and India running around to attract global FDI’s / Invesments for employment and growth must address theses judicial delays also.
People await for verdicts on their cases and the judges are transferred in between. Even judges have the right to back out from any case they want to. There is no accountability.
First, all vacancies in all courts should be filled up immediately. Then, all records be made computerized and then all laws be made compatible with the notion of quick delivery of justice.
Corruption in judiciary also cannot be ruled out. We know cases when judges are bribed to secure a bail or lenient sentence. For this, supreme court must make regulations.
When licences were awarded in the coal allocation then how can judiciary strike down decision of executive body. This has serious implications on business and investment environment in India.
Retirement age of supreme court judges can be made 68 or 70 and same should be for high court judges. All backlog of vacancies are to be filled without any delay to speed up justice.
Good that judiciary independence was not ruled out and NJAC was struck down by the Apex Court. If judicial appointments will involve politicans then corruption will prevail.
Accountability and transparency are the foremost need of any judicial system. Hence Indian judiciary must take into its fold both these concepts and make changes in their working.
Independent and transparent judiciary in the country will make no sense unless justice is speedy. Lok adalats and family courts and social courts at PRI level must be encouraged for this.

You can say that corporate decisions taken by executive should be irreversible however this takes away the climate of judicial review and rule of law.
